國際商法的翻譯技巧有哪些？

對國際商法語言特點的分析有助于確立合理的、行之有效的翻譯標準。歷來傳統的法律翻 譯方法是重“直譯”，輕“意譯”。翻譯公司翻譯員在法律翻譯中忠實原文更多地體現在法律術語的翻譯上，對于 句子結構，則大可不必拘泥于傳統的法律翻譯理論，重要的還是要保證譯文能夠通順、地道， 保證原文的意義能夠得到準確的傳遞，做到形可變而神不變。
1.詞匯的翻譯
對于法律專業術語的翻譯，必須以準確為先，切忌亂譯。遇到把握不準的意義表達時，應 借助工具書或網絡搜索引擎，查詢法律用語的確切含義。常用法律英語工具書有法律出版社的 《元照英美法詞典》和《牛津現代法律用語詞典》。在使用網絡搜索引擎查詢法律術語含義時， 要多做對比，尤其要比對中英文網站的解釋有無差別。
對于并非法律語體所獨有的術語，例如parties，item，instrument，suspension，resolution， act等在法律語體中，有其確切含義，翻譯時應搞清其特殊法律詞義，并堅持“直譯”原則： parties譯為“當事人/方/國”：item譯為“款”；instrument譯為“法律文書”；suspension譯 為“終止”。。
由于不同國家的法律存在差異，有時源語言中所表達的法律含義在目標語言中不存在，或 是直譯得到的目標語言詞匯所表達的含義與源語言不同，在翻譯時應特別注意。例如：obligation ofacontract譯為“妨礙司法”，而不是“合同的義務”；stmwman譯為“掛名負責人”，而不是 “稻草人”；causeofaction在法律文書中應譯為“案由”，而不是“行為原因”。
2.長句的翻譯
法律英語中較多使用長句是由法律語言的特殊性所決定的。在翻譯法律英語長句時要先從 語法分析入手，充分理解源語文本的意思，然后將其意思用通順的漢語翻譯出來。換句話說， 長句的翻譯可以簡化為“破”和“立”兩個過程?！捌啤笔侵钙饰龀鲈牡闹骶?、重心及整個句 子含義，并進行拆解，探析句子中的幾層含義?！傲ⅰ笔侵附Y合所涉專業知識，以漢語的表達習 慣方式翻譯原句并精心組織目的語。例如：
原文：When there are two or more creditors or debtors to a deal, each of the joint creditors shall be entitled to demand that the debtor fulfill his obligations, in accordance with legal provisions or the agreement between the parties; each of the joint debtors shall be obliged to perform the entire debt, and the debtor who performs the entire debt shall be entitled to ask the other joint debtors to reimburse him for their shares of the debt.
分析：這是一個復合句，共有78個單詞。全句有三個并列句組成，分別是：each of the joint creditors shall be entitled to…； each of the joint debtors shall be obliged to…； the debtor shall be entitled to…對于這三個并歹ij句而言有一個共同的時間狀語從句：When there are two or more creditors or debtors to a deal。另外有一個由who引導的定語從句修飾the debtor。通過語法分析，
理清脈絡后，可組織譯文如下：債權人或債務人一方人數為二人以上的，依照法律的規定或者 當事人的協議，享有連帶權利的每個債權人，都有權要求債務人履行義務；負有連帶義務的每 個債務人，都負有清償全部債務的義務，履行了義務的人，有權要求其他負有連帶義務的人償 付他應當承擔的份額。
